Notice Of Proposed Property Disposition & Intention To Provide Assistance
In accordance with Sections 24, 26, and 94 of the Community Charter, notice is hereby given that the City of Cranbrook proposes to dispose of the property described below to Rotary Club of Cranbrook:
Legal description: LOT 1 DISTRICT LOT 22 KOOTENAY DISTRICT PLAN EPP150489
Consisting of approximately 0.313 ha
The proposition is sale of the fee simple interest in the Land for the purpose of building a seniors affordable housing project consisting of 12-14 dwelling units on property located at 5th Street South. The consideration to be received by the City of Cranbrook is $1 subject to the following:
- inclusion of provision for the property to be returned to the City with no compensation to the Rotary Club of Cranbrook in the event the property is not used for the purpose intended within a period of two (2) years;
- grant of right of first refusal to the City if the property were to be sold;
- Rotary Club of Cranbrook to rectify encroachments on the property from the adjacent St. Mary’s School property as part of the development process;
- Provide a trail connection to Rotary Way along 5th Street South right-of-way as part of the development; and
- Registration of a housing agreement/covenant for affordable housing.
